1.1. Thomas Busby (headright of Arthur Bayly), m. Susannah Grey, dau. of Capt. Francis Grey, of Surry Co., and was br.-in-law of Peter Grey, and Anthony Allan (who had m. a sister of Sussanah and Peter Grey).

Anthony Allen’s son, Francis, was named as Thomas Busby’s nephew (B. 1, p. 162).
Peter Grey gave 300 ac. of Thomas Busby’s land in Chippoaks, as part payment of a debt of 760 lbs. of tobacco, to Thomas Drewe. (Charles City Co. Orders, p. 327). Thomas Drewe acknowledged in court to have received 2,500 pounds of pork from Thomas Busby in payment of a bond; see hereinafter.

“Knowe all men by these presents that I Thomas Busby of Virginia Planter freely sell unto Peter Grey, 800 ac. lying and on the Southerne Run of Chippoaks Creeke in ye County of Surry, adjoyning to the land now in the possession of Jno. Barker”.* Signed in the presence of Francis Grey, Anthony Allen. Nov. 10, 1660. *John Barker Jr., Thomas Busby’s son-in-law.

Others claimed as headrights of Arthur Bayley* on Jan. 16, 1637 were John Harris and William Barker, father of John Barker Sr. William Barker, bapt. on May 7, 1592, in St. Werburgh’s, Bristol; merchant and mariner, was a business partner of Francis Derrick Jr. (Calendar of State Papers, Domestic Series, of the Reign of Charles I, vol. 10); b. in 1607 in Long Ashton, Somerset.

He bought 30 ac. from John Baker (Barker) and his wife, Dorothy, “daughter of the late deceased Sergeant John Harris”, belonging to the late deceased George Cawcott which was given to the said Dorothy by the last will and testament’, p. 113.

In the patois relevant to Somerset at this time, Cawcott is synonomous with Cockett: Silvester Thacker and Anthony Fulgham (of Pitminster, Somerset), 100 acs. IOW Co., Oct. 22, 1646, upon Pagan Point Bay, E. upon land of Mr. Thomas Davis and S. upon Mr. John Mahoone. Trans, of 2 pers: John Cockett & Sarah Robinson, p. 93. Thomas Busby’s land grant:

“Know ye that I Edward Diggs Esq, give and grant unto Thomas Busby Four Hundred acres of land Lying and being in Surry County on the south side of the western head of upper Chippoakes Creek beginning on Mr. Moseley line near the path that goes to Mr. Barkers; N. E. by E. 61 chains thence again on the said Moseleys line N. 115 chains and thence to John Barrowes Line; E. by N. 59 chains thence S. to the Southern run 10 chains thence on transverse up the Southern Run 188 chains to a corner marked here. Thence west to the said path 74 chains thence to the place it began. Mr. Robert Moseley sold his tract to Arthur Jordan Sr., on Oct. 28, 1657, who sold it to William Short Sr., ca. 1660:

1691. The Deposition of Mr. Thomas Busby, aged fifty nine yeares or theireabouts, being examined & sworne, saith: That thirty foure yeares agoe, or thereabouts, Robert Moseley, then liveing on the plantacon now in possession of Edward Green in the uper end of Surry County made an outcry of his whole estate as well (as) lands and other things & that the sheriffe of the county being absent, this deponent was cryer at the said outcry and that Mr. Arther Jordan then bought about eleavon hundred acres of land, the said land being that tract whereon the said Green now liveth, for which the said Jordan was to give tenn thousand pounds of tobacco & that one W. Short, then an inhabitant in Charles City County being at the said outcry, gave the said Jordan some advantage for his bargain, and discharged the said Jordan, and gave the said Moseley caution (Security) for the said land: and that the said Moseley in a very short time after the said outcry, went down to the house of Mr. Arther Allen and their sickened and dyd, and further this deponent saith that about two or three yeares after, Mrs. Short, her husband being then dead, sent down to Cabbin point about two thousand or two thousand five hundred pounds of porke *which this deponent delivered by her order as part of payment (to Thomas Drewe) for the said land, and further this deponent deposith that about two years after the payment of the said porke this deponent paid about six or eight hundred pounds of tobacco for the use of the said Mrs. Short, which to the best of his remembrances was the last payment for the said land. *In ca. 1660, Thomas Busby bought a horse from “Mathew Battell, Cooper, in the county of Surry”, witnessed by Thos. Pittman, Barth. Owen. (B.1, p. 157). Thomas Busby traded in horses. “These presents shall engage us, William Lea and Alice Lea assignes to deliver to Thomas Busby one grey mare presently downe, for him to posess & his heires, greatly to enjoy for ever. And wee the said William & Alice Lea doe rattifie & confirme, by the virtue of this our act & deed, peaceable possession of the said Mare with her increase unto the said Busby & his heires as aforesaid. Further wee doe bind ourselves & our heires to warrant the sale of the said mare to defend forever in law and to acknowledge the sale to be lawfull in Surry County Court (Surry County Deeds, No. 1, , p. 162).

Returning to Thomas Busby’s in-laws:
Francis Grey was granted 750 ac. in Charles City Co., Nov. 24, 1653 (Nugent, p. 231), claiming Grace Singleton as a headright, whom some assume to be his wife. In 1665, Mrs. Grace Grey complained to the Charles City Co. Court about her husband’s ill-treatment of her. She stated that they had been m. for 24 years, and he had received a good dower, though he was poor, and that she had bore him 6 living children. From this, Grace can be assumed to have been born ca. 1620. Why she was claimed as an headright in 1653 under her maiden name is problematic, and it should be considered whether she was a sister of Mary, wife of William Short Sr., who, Thomas Busby, as overseer of her husband’s estate, was ordered to provide her maintenance for life. (B. 2, p. 106).

Jane Browne was the dau. of Colonel William Browne and his first wife, Mary (Colonel William Browne m. (2) the relict of Nicholas Meriwether Sr.); and sister of:

The will of Elizabeth Heath was filed in 1731 in Surry County Elizabeth (last name unreadable), widow, it would seem, of John Avery The appraisers were William Short, Mr. William Short, Jr. and William Harris.
